We hereby inform you that the data we gather regarding your activity,which have been collected through the different channels of the Platformand which include your purchases, shall remain linked to your account sothat all the information can be accessed together. - For the development, performance and execution of the purchase or services contract that you executed withUs on the PlatformThis purpose includes processing your data, mainly:
- To contact you for updates or informative notices related to thecontracted functionalities, products or services, includingquality surveys and to be able to establish the degree ofcustomer satisfaction with the provided service.
- To manage payment of the products that you purchase,regardless of the payment procedure used. For example:
- If on purchasing any of our products through the Website or the App,you opt to activate the functionality of save your payment data andyour shipment address for future purchases, where thisfunctionality is available, we need to process the indicated data foractivation and development of that functionality. Consent to theactivation of this functionality enables your autocompleted paymentdata to appear in subsequent purchases so that you do not need tointroduce them in each new process, and these data will be deemedvalid and effective for subsequent purchases. If we consider thatthe transaction may be fraudulent or we detect abnormalbehaviour which indicates attempted fraudulent use of ourfeatures, products or services, this processing may result inconsequences such as the blocking of the transaction or thedeletion of your user account.
- To manage potential exchanges or returns after you havepurchased and manage requests of availability information forarticles, reservations of products through the Platform,depending on the availability of such options from time to time.
- For invoicing purposes and to make available to you the ticketsand invoices of the purchases you have made through thePlatform.
- To ensure that you are able to use other availablefunctionalities or services, such as the purchase, receipt,management and use of the Gift Card or of the Gift Voucher and to afford you access and use of the Wi-Fi that we make availableto our customers at Brick-and-Mortar Stores.
- To be able to offer you through the App specific services (suchas item finder, reserve a fitting room, etc.) available in someBrick-and-Mortar Stores, we may process your location andcontact data.
3. To meet requests orapplications that you makethrough the Customer Service ChannelsWe only process the personal data that are strictly necessary to manageor resolve your request or application.
If you contact us via telephone, the call may be recorded for qualitypurposes and so that we can respond to your request.If it is available, and you choose to use WhatsApp as a channel tocommunicate with Customer Support, we will share your telephonenumber with WhatsApp Inc. (a company located in the U.S.A.) to confirmthat you are a user of this service. We recommend you review yourprivacy settings and to read WhatsApp privacy policy to obtain moredetailed information about the use that WhatsApp makes of the personaldata of the users that use their services.
If it is available and you choose to communicate with Customer Supportthrough the chat service of a social network or another collaborator, someof your personal data such as your name or user name, will be importedfrom your social network or collaborator account. Also, bear in mind thatthe data you submit on this service will be available to your social networkor collaborator and subject to their privacy policies, therefore Werecommend you to review your privacy settings and to read the social network or collaborator privacy policies to obtain more detailedinformation about the use they make of your personal data when usingtheir services.
4. For marketing purposes. This purpose includes the processing of your data, mainly, for:

- If and when you subscribe to our Newsletter, we will process yourpersonal data to manage your subscription, including to sendcustomised information on our products or services throughvarious means (such as e-mail or SMS). We may also makeavailable to you this information through push notifications in caseyou have activated them in your device.

If you do not want to receive pushnotifications, you can deactivate this option in your device.
- Show you ads on the Internet which you may see when visitingwebsites and apps, for example, on social media. The ads yousee may be random, but on other occasions they may be adsrelated to your preferences or purchase and browsing history.
- If you use social media, we may provide the companies withwhich we collaborate certain information so that they, as jointcontrollers, can show you our brand ads and, in general, offeryou and users like you advertisements which take into accountyour profile on said social media sites. If you want informationabout the use of your data and how advertising works on socialmedia, we recommend you review the privacy policies of thesocial media sites on which you have profiles.
- We also use your data to carry out measurement and segmentanalyses on the ads which we show users on some of ourcollaborators’ platforms. On participating in any promotionalaction, you authorise us to process the personal data that youhave shared with us depending on the promotional action anddisclose them through different media such as social networks orthe Platform itself. In each promotional action in which youparticipate you will have available the terms and conditions wherewe will be providing more detailed information about theprocessing of your personal data.
- To disseminate in the Platform or through our channels in thesocial networks photographs or pictures that you shared publicly,provided that you expressly give us your consent for the purpose.
5. Analysis of usability andquality to improve our services
If you access our Platform, we inform you that we will treat your browsingdata for analytic and statistic purposes, i.e., to understand the mannerin which users interact with our Platform and with the actions weimplement on other websites and apps, so we can improve our services.
In addition, we occasionally perform quality surveys and actions toknow the degree of satisfaction of our customers and users and detectthose areas in which we may improve.
HOW ARE WE LEGALLY PERMITTED TO PROCESS YOUR DATA?

- Development, performance and makingof the purchase or services contract
We process your data because their processing is necessaryfor us to make the purchase or services contract with you.
Certain processing of data related to the purchase process isactivated only because you request or authorise it, as is thecase of the storage of payment data for future purchases orthe processing of data necessary to scan the till receiptsthrough the Wallet section of the App or to provide you withthe Coming Soon / Back Soon functionalities, where thesefeatures are available. In these cases, our processing of yourdata is supported by your own consent. In addition to this, weprocess your location data when you provide us your consentin order to offer you specific services through the App whenvisiting some of our Brick and Mortar Stores.
We consider that we have a legitimate interest to carry outthe necessary verifications to detect and prevent potentialfraud or fraudulent uses of the Platform, for example when youmake a purchase or return or to analyze the efficiency ofseveral services included in the Platform, such as for example,the Size Recommender tool.
We understand that theprocessing of these data is positive for all the parties involved:
for you, as it allows us to put in place measures to protect youagainst attempted fraud perpetrated by third parties; for Us, asit allows us to avoid unauthorised uses of the Platform; for allour customers and society, as it also protects their interest byensuring that fraudulent activities are discouraged anddetected when they do occur.

We understand that the processingof these data is also beneficial to you to the extent that itenables us to assist you adequately and answer to the queriesraised.
When you get in touch with us, in particular, for themanagement of incidents related to your order or theproduct/service acquired through the Platform, the processingof your data is necessary to perform the purchase contract.
When your request is related to the exercise of your rights onwhich we inform you below, or to claims on our products orservices, we are legally permitted to process your data forcompliance with our legal obligations.
- Marketing We are legally permitted to process your data for marketingpurposes due to the consent that you give us, for examplewhen you accept receiving customized information throughmultiple channels, when authorizing the sending of pushnotifications in your device, when you configure it in theprivacy settings of your device, when you consent through thecookies settings or when accepting the legal terms andconditions to participate in a promotional action or to publishyour pictures on the Platform or on our social networks’channels.

HOW LONG WILL WE KEEP YOUR DATA?
The time for which we will keep your data will depend on the purposes for which we process them, as explainedbelow:

- Marketing We will process your data until you unsubscribe or cancelyour subscription to the newsletter.
Likewise, we will show you personalised ads until youchange your device, browser and or cookies settings so thatpermission to do so is revoked.
If you participate in promotional actions, we will keep thedata during a six (6) months period from the end of theaction.

Basically, we will retain your personal datafor as long as is necessary to fulfil the purpose for which the data was collected and any other permitted linkedpurpose. Once each of the potential actions is time-barred we will proceed to delete the personal data.
DO WE SHARE YOUR DATA WITH THIRD PARTIES?
To achieve the purposes mentioned in this Privacy and Cookies Policy, we must give access to your personaldata to entities of the Inditex Group and to third parties that provide us with support in the services that weoffer your, i.e.:

- anti-fraud detection and prevention entities,
- technological and analytical service providers,

- providers of customer support related services,

- Government, regulatory or law enforcement agencies – We may also process your personal data tocomply with our regulatory requirements or in the course of dialogue with the regulators as applicable,which may include disclosing your personal data to government, regulatory or law enforcementagencies in connection with enquiries, proceedings or investigations by such parties anywhere in theworld or where compelled to do so. Where permitted, or unless to do so would prejudice the preventionor detection of a crime, we will direct any such request to you or notify you before responding / sharingyour personal data with any regulator.
For service efficiency purposes, some of these providers are located in territories outside the EuropeanEconomic Area that do not offer a level of data protection comparable to that of the European Union. In the event that we sell or transfer all or a portion of our business or assets to other company within or outside Asgari Enterprise, or have any other business operation implemented as a consequence of corporatereorganizations, we may disclose your personal data to the prospective receptor of such business or assets.
Should such a sale or transfer occur, we will use reasonable efforts to direct the transferee to use personalinformation you have provided to us in a manner that is consistent with our Privacy and Cookies Policy. Furthermore, if you choose to use the Platform in different markets (i.e. by creating registered user accounts indifferent markets with the same e-mail address), We may need to disclose or transfer the information linked toyour account or your activity to the companies of the brand operating in those markets, to the extent they aredirectly involved in the achievement of any of the purposes described in the section 2. We consider this isnecessary in accordance with our mutual interests and preferences.
6. WHAT ARE YOUR RIGHTS WHEN MAKING YOUR DATA AVAILABLETO US?
We undertake to keep your personal data confidential and to ensure that you may exercise your rights. If we consider thisnecessary to be able to identify you, we may request you to provide a copy of a document evidencingyour identity.

- To request that we cancel or limit the processing of your personal data, which entails that in certaincases you can request us to temporally suspend the processing of the data or that we keep them longerthan necessary.

If you provide us with personal data of third parties or if itis necessary that we request them for a third party to collect an order in your name, you confirm that you informedthem of the purposes and of the manner in which we need to process their personal data.
